BALLARD COMPUTING SERVICES CUSTOMER AGREEMENT

    We at Ballard Computing Services take malware and PC problems very seriously, and will take every precaution available while working on your system, but would like you to know what the risks are before your computer goes on the bench.

    VIRUS / MALWARE REMOVAL- Ballard Computing Services (BCS) will make every effort to safely and effectively remove all of your viruses and malware. You, the client, by allowing BCS to take your computer agree that you will indemnify and hold harmless Ballard Computing Services. Viruses in a computer can cause many problems. BCS cannot control what the virus affected in the computer before removal or after attempted removal. We therefore cannot be held liable for damages.

    Work Authorization - Ballard Computing Services will never perform work that has not been approved by Client.

    CONFIDENTIALITY - We take your privacy very seriously. The contents of confidential user data are not inspected, “opened”, or viewed, and will only be accessed with your approval in order to perform the necessary work. Under no condition will BCS be held liable for security issues related to having had access to data stored on your computer. Due to the requirements of the repair, if approved by you, we will back up your data to insure that you have all the files you started with when a computer is returned to you. BCS will destroy said data on their backup devices immediately upon completion of the job and will never hold this data.

    INDEMNIFICATION OF DAMAGES - BCS will take every precaution to preserve all data and software on the computer. Occasionally, due to the nature of software repairs, data loss may occur and/or software operation may be compromised. You, the client, agree that you will indemnify and hold harmless BCS for any and all data or software that may be lost or erased, as well as for any consequence of the erasure or loss of that data or software. You, the client, agree that you will further agree to indemnify and hold harmless BCS for any and all hardware or software malfunctions or accidents that may occur before, during or after work is performed on Client’s computer, and for any results thereof.

    LIMITATIONS OF SERVICE - Ballard Computing Services reserves the right to refuse service to anyone and will not be held liable for any damages incurred through this denial of service.

    DISCLAIMER OF WARRANTIES- Client expressly agrees that use of Ballard Computing Services is at Client's sole risk. Ballard Computing Services shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use of or the inability to use Ballard Computing Services. All sales of refurbished equipment are final, but are covered by a 90 day hardware only warranty. Ballard Computing Services reserves the right to replace a defective unit with one of equal or greater value or refund money. The 90 warranty will be void if the product is used in such a way as to deliberately cause damage to the unit. Because most computers are connected to the internet, Ballard Computing Services cannot be held responsible for viruses or malware that your machine may pick up, therefore, the operating system and other software carries no warranty.

    ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS AND CONDITIONS - This Ballard Computing Services General Terms and Conditions (“Terms and Conditions”) is provided to you (“Client”) in connection with the services and products offered and/or rendered by Ballard Computing Services ("BCS") . These terms and conditions comprise the entire agreement between Customer and Ballard Computing Services with respect to services rendered and products supplied/delivered.
